1. Agreement to Terms

By accessing or using Arche at thearche.ai ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Service. Arche is operated by Stone Sargent, a sole proprietor doing business as Arche ("Arche," "we," "us," or "our").

2. Description of the Service

Arche is an AI cofounder and autonomous agent workforce. Its agents help you plan a company and can, at your direction, write and ship software to your own code repositories, draft and send communications, publish marketing content, and monitor your deployed applications. The Service is provided "as is" and may be updated, changed, or discontinued at any time.

3. Eligibility

You must be at least 18 years old and able to form a binding contract to use Arche. By using the Service, you represent that you meet this requirement.

4. Accounts

To use most features you must create an account. You agree to provide accurate information, keep your credentials secure, notify us promptly of any unauthorized access at support@thearche.ai, and accept responsibility for all activity under your account.

5. Authorization of Autonomous Agents and Actions

Arche is an autonomous system that takes real-world actions on your behalf. By using the Service and by connecting your accounts, you authorize Arche's agents to perform actions including, without limitation:

  • writing to and committing code to your connected GitHub repositories;
  • deploying applications and changes to hosting environments;
  • drafting and sending emails from addresses you connect or authorize;
  • creating and publishing social media and marketing content; and
  • consuming metered resources (such as AI API calls and cloud sandbox time) that count against your plan and any spending limits.

You acknowledge and agree that:

  • Approval gates. Actions that affect the outside world are presented to you for approval before they execute. If you enable autonomous ("overnight") operation, you authorize agents to act on a recurring schedule without a separate real-time prompt for each action; you may pause or disable autonomous operation at any time.
  • You are responsible for what you approve and enable. You are solely responsible for reviewing proposed actions and for any action you approve or that runs under an autonomous mode you have enabled, and for the consequences of those actions.
  • Agents can be wrong. AI agents may make mistakes, misunderstand instructions, produce errors, or take actions with unintended effects. You are responsible for reviewing agent work before relying on it.
  • You can stop it. You may revoke connected-account access, disable autonomous operation, or stop using the Service at any time.

To the maximum extent permitted by law, Arche is not liable for the outcomes of actions you or your agents authorize, approve, or enable, including deployments, code changes, communications sent, content published, or resources consumed. This Section survives termination.

6. Connected Accounts and Third-Party Services

Arche integrates with Anthropic, Supabase, Vercel, GitHub, E2B, and Resend to provide the Service. When you connect a third-party account (for example, GitHub with repository read/write access), you authorize Arche and its agents to access and act within the scope you grant. Your use of connected services remains subject to their own terms, and you are responsible for maintaining and, if you wish, revoking those connections. We are not responsible for the availability, actions, or policies of third-party services.

7. Fees, Metered Usage, and Spending Limits

Arche's billing model is usage-metered. Consumption of resources — such as AI API calls and cloud sandbox runtime — is measured per use and accounted against your plan. Plans are expected to include a base tier with a usage allowance and higher paid tiers with larger allowances; exceeding an allowance may prompt an upgrade rather than interrupting work in progress, and a hard spending ceiling is intended to pause autonomous activity as a safety limit.

Paid billing is not yet active. We are not currently charging for the Service, and the pricing, allowances, and limits described here are informational and subject to change before billing launches. When we enable paid billing, we will make current pricing available and provide notice before charges begin. We may change pricing with at least 30 days' notice to existing paid subscribers. Except where required by law, fees (once charged) are non-refundable.

8. Acceptable Use

You may:

  • use Arche to plan, build, and operate businesses for personal or commercial purposes;
  • use and deploy the code your agents generate; and
  • connect your own accounts and services.

You may not:

  • use Arche to violate any law;
  • build or ship applications designed to harm, defraud, or deceive;
  • generate spam, malware, or harmful content;
  • infringe others' intellectual property or privacy;
  • reverse engineer, scrape, or extract the Service or its underlying models;
  • circumvent rate limits, spending limits, or security controls;
  • resell or sublicense access without our written permission; or
  • use the Service to build a competing autonomous-agent product.

9. Intellectual Property

Your content and code are yours. You retain ownership of the ideas, content, and instructions you provide, and of the code your agents generate and the GitHub repositories they populate. By using Arche, you grant us a limited, non-exclusive license to process your inputs and operate on your connected accounts solely to provide the Service. Arche's platform — including its design, software, agent systems, and prompts — is our intellectual property; you may not copy, reproduce, or distribute it without permission. We do not claim ownership of code generated for you, and we make no warranty that generated code is free of third-party intellectual-property claims.

10. AI-Generated Content and Actions Disclaimer

You acknowledge that:

  • AI-generated code may contain errors, bugs, or security vulnerabilities;
  • agent actions (including commits, deployments, emails, and posts) may be incorrect, incomplete, or have unintended consequences;
  • generated applications are prototypes and may require review and hardening before production use; and
  • you are responsible for reviewing, testing, and validating any code or action before relying on it.

Arche is not responsible for the quality, security, or consequences of AI-generated code or agent actions.

11. Termination

You may stop using the Service or request account deletion at any time by contacting support@thearche.ai. We may suspend or terminate your access immediately if you violate these Terms or create risk to the Service or others. Upon termination, your right to use the Service ceases; code already committed to your own GitHub repositories remains yours.

12. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

13. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ARCHE AND ITS OPERATOR SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, DATA, GOODWILL, OR BUSINESS, ARISING FROM OR RELATED TO THE SERVICE OR ANY AGENT ACTION. OUR TOTAL LIABILITY FOR ANY CLAIM SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM, OR (B) USD $100.

14. Indemnification

You agree to indemnify and hold harmless Arche and its operator from any claims, losses, damages, liabilities, and expenses (including reasonable legal fees) arising from your use of the Service, the actions you or your agents authorize or approve, your content, or your violation of these Terms.

15. Governing Law

These Terms are governed by the laws of the State of Texas, United States, without regard to conflict-of-law principles. Any dispute will be resolved in the state or federal courts located in Texas, and you consent to their jurisdiction. Where you have non-waivable consumer rights under the laws of your place of residence, those remain unaffected.

16. Changes to These Terms

We may update these Terms from time to time. For material changes, we will provide at least 14 days' notice by email or in-app. Continued use after the effective date constitutes acceptance.
